Vermessener Kommentar zu Fracking-Verbot

Betr: UN soll Fracking verbieten (AZ, 16. Juli 2021)
Ich finde es vermessen, dass Sie beurteilen können, wer sich in diesem Fall intensiv mit der Materie beschäftigt hat und insofern berechtigt ist, ein Verbot von Fracking erwirken zu wollen.

1. Ich verweise an dieser Stelle auf einige Quellen:

„In May 2018, the Permanent Peoples Tribunal (PPT) on Human Rights, Fracking and Climate Change heard testimony and received other evidence relating to fracking and its impact. Included were very substantial reports from four prior PPT Citizens’ Tribunals that had gathered scientific, technical, social, cultural and experiential testimony from many community organizations, experts and individual citizens. According to the preliminary statement of the PPT judges, “the evidence clearly demonstrates that the processes of fracking contribute substantially to anthropogenic harm, including climate change and global warming, and involve massive violations of a range of substantive and procedural human rights and the rights of nature.… The evidence also shows that governments have, in general, failed in their responsibility to regulate the industry so as to protect people, communities and nature. In addition, they have failed to act promptly and effectively to the dangers of climate change that fracking represents.”



[i] In the final Advisory Opinion, the PPT recommended that “fracking be banned” and that “the Special Rapporteur on Human Rights and the Environment be asked to investigate the violations of the rights of humans and nature by the Unconventional Oil and Gas Extraction industry.”



[ii] This finding is echoed elsewhere: In October 2018, the UN’s CESCR issued an official warning concerning fracking for shale gas in Argentina, saying that „the Committee is concerned that this hydraulic fracturing project contradicts the State party's commitments to the Paris Agreement, with a negative impact on global warming and the enjoyment of the economic and social rights of the world population and future generations. (Article 1 (1) and 2 (1)) “.



[iii] In March 2019 the United Nations Committee on the Elimination of Discrimination Against Women (CEDAW) urged the British Government to “consider introducing a comprehensive and complete ban on fracking.”



[iv] In June 2019, the Human Rights Council published a report on climate change and poverty, clearly highlighting the fact that “fossil fuel companies are the main driver of climate change” and that “the track record of the fossil fuel industry makes clear that overreliance on profit-driven actors would almost guarantee massive human rights violations”.

Check also report of the Special Rapporteur on human rights and the environment entitled “Safe Climate” (15 July 2019) (A/74/161) which recommended that developed Member States should demonstrate leadership by



(i) prohibiting further exploration for additional fossil fuels, since not all existing reserves can be burned while still meeting the commitments of the Paris Agreement,



(ii) rejecting any other expansion of fossil fuel infrastructure, and



(iii) prohibiting the expansion of the most polluting and environmentally destructive types of fossil fuel extraction, including oil and gas produced from hydraulic fracturing/fracking, oil sands, the Arctic or ultra-deepwater.

The UNEP 2012 Alert concluded that fracking may have environmental impacts, even if done properly, and that existing regulations are insufficient.

The Compendium of Scientific, Medical, and Media Findings Demonstrating Risks and Harms of Fracking (the Compendium) is a fully referenced compilation of evidence outlining the risks and harms of fracking (https://concernedhealthny.org/compendium/).

Das würde ich auf jeden Fall als Lektüre empfehlen.

Raten Sie mal, wer jahrelang im Kuratorium der BGR war? Damals unter anderem Vorstandsmitglieder von K+S AG, Wintershall und ExxonMobil (siehe dazu u.a. https://www.bgr.bund.de/DE/Gemeinsames/Produkte/Downloads/Taetigkeitsberichte/taetigkeitsbericht_2011.pdf;jsessionid=AA78CC8FDAA6192F811408456725C353.2_cid321?__blob=publicationFile&v=2).

Die Frage der „Unabhängigkeit“ der BGR und ihre unreflektierte Haltung zu Fracking (vor allem Schiefer-Fracking und die damit einhergehende Industrialisierung ganzer Landstriche) kann jeder selbst beantworten.

3. Deutschland hat übrigens Fracking in Schiefergestein verboten. Andere EU-Länder haben es in allen Gesteinsschichten verboten (z.B. Irland).



4. Der Bericht International Human Rights Impacts of Fracking (https://bit.ly/3rBqhXR) des irischen Zentrums für Menschenrechte – veröffentlicht im Mai 2021 – verweist auf alle oben dargelegten Entscheidungen und hebt auch die Bedeutung der Beweise hervor, die über die Jahre von den „Concerned Health Professionals of New York“ gesammelt und im „Compendium of Scientific, Medical and Media Findings Demonstrating Risks and Harms of Fracking“ (7. Auflage, veröffentlicht im Dezember 2020) dokumentiert wurden.
